Mr. Kushner's mediation style is a mixture of both facilitative and evaluative. He tells the parties "bring your toothbrushes" as he believes that with sufficient time, almost all disputes can be resolved. Mr. Kushner expects both the attorneys (acting as counselors) and their clients (the decision-makers) to be actively involved in the process, particularly the clients, since they are the ultimate decision-makers.
