Drafted and negotiated 100's of AIA / GBC / and Municipal Contracts, is particularly experienced in negligence-liability, breach, negligence, errors / omissions and professional standards' claims. As a Florida Circuit Civil Certified Mediator since 2010, and licensed to practice architecture in 20 states with plus 55 years of experience, has served as a Mediator in 50 plus Florida Residential Foreclosure Meditations; one Civil Court-ordered mediation in Miami-Dade 11th Circuit. Since 2010, mediated six actual construction dispute cases plus Arbitrated 10 construction dispute cases. My expert witness cases number 100 plus, in the fields of construction, accidental death and copyright infringements.
Issues in foreclosure mediations included borrower defaults, HAMP, short sale, deed-in-lieu and HAFA. Civil mediation involved a workman's compensation matter.
Architects, through their specialized training and experience of applying a balance of art and science in designing buildings are natural problem solvers. To achieve a "wise" outcome, every mediation process as an art form, together with a mediator as an impartial neutral, must be grounded on a clear set of guidelines to facilitate a consensual process. These guidelines include mutual respect, open communications, confidentiality, empowerment of each party and a clear progression of narrowing the dispute issues, to achieve a fair, reasonable and balanced outcome.
