During a distinguished career of almost 30 years as a practicing attorney, conducted countless jury and non-jury trials, hearings, discovery conflicts, and motions. Since 2009, after extensive training, began mediating cases for the Middle District Court and private parties. After years of representing parties in grievance and interest arbitrations, began arbitrating cases for Dauphin County.
Since 2012, has served as a mediator for the Middle District of Pennsylvania’s court annexed mediation program, and in private mediations, in approximately 30 cases. The bulk of mediations have been in employment-related and contract/commercial matters, but has also mediated personal injury cases involving large insurance companies. In one of the personal injury cases, it was a multiple party medication.
Extensive experience in mediating a wide range of employment-related legal issues, including discrimination based on sex, sexual harassment, sexual orientation, race/color, national origin, age, religion, disability, as well as hostile work environment, wrongful termination, and retaliation. <br/><br/>Proficient in handling cases related to various statutes, such as Title VII, FMLA, FLSA, Section 1983 constitutional issues and "whistleblower" laws, as well as contract law, including wrongful discharge, executive compensation, and non-compete agreements.<br/><br/>Knowledgeable in mediating issues concerning the Americans with Disabilities Act (ADA) and requests for accommodation and the Age Discrimination in Employment Act (ADEA).<br/><br/>Experienced in resolving general business and civil disputes, including breach of contract, business torts, fraud, automobile accidents, consumer disputes, and insurance cases.<br/><br/>Personal injury claims have involved intentional tort and workers' compensation issues, as well as contributory negligence.<br/><br/>Single and multi-plaintiff and defendant cases.
I use a combination of mediation styles depending on the situation and the needs of the parties involved. The choice of mediator style may vary based on the type of conflict, the cultural context, and the preferences of the parties seeking mediation. I do tend to be a facilitative mediator as my focus is to encourage active participation from all parties, facilitate dialogue, and use active listening techniques to help parties understand each other's perspectives and generate their own solutions. At times I use more of a directive approach particularly when the parties are unable to think of solutions on their own or when time constraints require speeding up the process or a more structured approach. Directive mediators take a more active and directive role in the process, providing guidance and suggestions for potential solutions. They may offer specific recommendations, propose options, or make suggestions based on their expertise or knowledge of the subject matter.
Have a solid foundation and proficiency in various technologies. Comfortable working with common office productivity software such as Microsoft Office and Adobe, and adept at using email and web browsers. Additionally, have experience with video Conferencing platforms like Zoom, Microsoft Teams, Google Meet, and Cisco Webex which used extensively during the pandemic.
