Mediated over 50 cases for eight years involving owners, developers, contractors and major subcontractors. These cases have dealt with construction projects, healthcare facilities, residential condominiums, sports arenas, Higher ED facilities and airports. Involved in several successful Zoom Arbitrations and Mediations with AAA. Very comfortable with Zoom procedures and have conducted cases with several parties with up to 15 participants.
Issues handled as a mediator have included contract disputes on the scope of work, delay, claims, quality, etc.
To be a good mediator, you must understand the issues and understand each party’s position. You need to know the contract, contract issues and the interest of both parties. I require a brief pre-hearing summation from each party outlining their position and any supporting documents. I become very familiar with these issues. I require that both parties come to mediation prepared and willing to resolve the issue. I expect that each party understands their issue and the other party’s position. During the mediation I will be a facilitator, meeting with each party privately and discussing their positions while advising them of industry standards based on my experience of managing over $30 Billion dollars of construction projects. I will only facilitate the conversation and will not come to a conclusion, but I will work to insure that both parties understand their opponent’s position. I will advise how an arbitrator may interpret the information during an arbitration. I will privately discuss with each party a cost-value benefit, but I will also work as a mediator to make each party understand the importance of resolving the issue at mediation. The parties must come to their own conclusion that if they do not resolve their issue by coming to a meeting of minds at mediation, they proceed to arbitration where the outcome may not be in their favor. Most importantly, as a mediator, I need to obtain each party’s trust; I hold all discussion and shared materials confidential. I believe it is important that each party knows that they can be perfectly honest with me, without concern, and that all information will be kept confidential.
