Mediator and Chief Legal Officer
Tyler is Chief Legal Officer of Gemini, which operates fully regulated digital asset exchanges in North America and Europe and serves users around the world. In addition, Gemini is a digital asset custodian, including for exchange traded funds and other institutional users through its limited purpose trust company, Gemini Trust Company, LLC. In this role, Tyler manages a team of lawyers in Asia, Europe, and the United States. <br/><br/>Tyler began his career in 1993 as a prosecutor in San Francisco, and then transitioned to civil practice in 1998. After gaining early experience in complex litigation, he founded a boutique civil litigation firm in 2004. Tyler represented plaintiffs and defendants in a broad array of complex litigation until he joined Gemini in 2024. High value contract disputes were a mainstay of his practice. He continues to mediate through Presidio ADR, which he founded in 2022.
Tyler has deep experience with eight-, nine-, and ten-figure settlement negotiations, both as a mediator and as counsel. He quickly grasps complicated dynamics, and subtle nuances as well. Having worked on both sides of the “v” throughout his career, he understands the perspectives of plaintiffs and defendants. Tyler is creative, pragmatic, and dogged in pursuit of resolution.
Tyler has mediated and resolved a broad array of cases pending in state and federal courts.
There is no single approach suitable for all mediations. A good mediator must remain nimble, attuned to the unique dynamics of each case—as well as the evolving dynamics on the day of mediation. That said, there are three truths that frame Tyler’s approach to all mediations: First, thorough preparation by the mediator leads to better outcomes. Second, a mediator who merely shuttles from room to room to convey numbers is rarely worth the money. The mediator must guide the negotiation (not only with facilitative techniques, but also with candid assessments of the parties’ respective positions). Third, most cases that do not settle during the formal mediation session can and should settle thereafter, so follow-up by the mediator is a crucial part of the process.
