Mediation is a process. How it flows depends upon the parties, the attorneys representing those parties, and the issues. There is a great deal of psychology involved. So, a mediator must be flexible. My general approach to each mediation is to be thoroughly prepared, to keep an open mind and not pre-judge, and to understand not only each party’s point of view but also the reasoning behind the position a party may take. Emotions, fatigue, different levels of risk assessment/tolerance, unreasonable expectations, communication issues, process mistakes all may play a role in the dispute resolution process. I do ask that the parties prepare mediation memoranda and, unless the parties agree otherwise, the memoranda will be confidential. I also ask questions and will provide my opinion when asked or when I believe it will help resolve the matter. Recognizing how many cases have an emotional component, I often ask the parties to view any decisions they will make as business decisions. My goal is to bring the parties as close together as possible. I further insist that the persons with authority to settle be present, preferably in person. When caucusing, I will keep discussions confidential unless I am told otherwise. I make it clear that, as a mediator, my intent and purpose are to serve the needs of the parties.
