Mediated and resolved all manner of commercial disputes. Frequently called upon to assist with partnership/shareholder/joint venture disputes, helping parties resolve differences with their business partners. These disputes often involve issues concerning the disposition intellectual property and trade secrets. Experience mediating cases involving claims of infringement and misuse of intellectual property, challenges to the validity of claimed IP or trade secrets, and the allocation of the rights to or royalties from the use of IP. Mediated numerous health-care related matters, particularly involving issues arising from the sale of medical practices. Also resolved a host of construction disputes, including matters involving defect claims, delay and other contract claims, and lien/bond claims.
Mediated dispute involving cyberfraud arising from interception of fast wire transfer involving claims of internal fraud and complicity.

Resolved matter arising from acquisition of medical practice and claims of interference and unfair competition by departing physician.

Mediated dispute between owners of defense contractor while entity was involved in debarment proceeding.

Helped settle licensing dispute between manufacturer and sub-contractor following change-in-ownership of sub-contractor involving theft of trade secret claims, breach of covenants-not-to-compete and unpaid royalty claims.
As an advocate, have mediated every kind of commercial dispute. Represented business owners in the full range of problems that can arise, ranging from disputes with investors at the beginning stages, conflicts with suppliers, customers and competitors as the business grew and prospered, and through disagreements arising or of buy/sell transactions and internal conflicts that can lead to the exit of an owner.
I view a mediator's primary job as making sure that parties have a clear understanding of what they hope to achieve in their dispute, understand the risks associated with the effort to achieve that goal and the barriers to success, and what their alternative outcomes look like if they do not succeed. Remarkably few participants have clear views of all three prior to mediation, so I spend a lot of time asking questions to challenge assumptions and pointing out possible alternative outcomes. I've found that parties have a great deal of satisfaction with the process, even if they do not resolve their dispute, since they typically emerge with a much clearer understanding of their case and their opponent. Even when cases do not resolve in the mediation session, the majority will settle later during a regularly scheduled follow-up call with counsel. I try to be tenacious in my after-session communications, since keeping the parties engaged frequently brings them to terms.
